BabyFoon Terms of Service

These terms govern your use of BabyFoon, a mobile application published by CB Engineering BV ("we", "us"), a company organized under the laws of Belgium. By installing or using BabyFoon, you agree to these terms. If you do not agree, do not use the app.

1. What BabyFoon is

BabyFoon is an audio-only baby monitor that runs on two or more phones you already own. One phone acts as the "baby" unit and listens for sounds; one or more "parent" phones receive alerts when sounds cross a threshold. The app supports a local-network direct transport and, when that is unavailable, a cloud relay through our backend provider (Supabase). Audio is end-to-end encrypted between your devices.

2. BabyFoon is not a medical device

Read this carefully.

• BabyFoon is not a medical device. It does not monitor breathing, heart rate, oxygen levels, body temperature, or any other vital sign.
• BabyFoon is not a substitute for adult supervision. You must not rely on BabyFoon as the sole means of monitoring your child.
• BabyFoon depends on the correct functioning of your phones, your home network, your power supply, and the operating systems and platforms it runs on. Any of these can fail at any time. The app may miss sounds, deliver alerts late, or deliver no alerts at all.
• You are responsible for testing the app in your own environment before relying on it, and for periodically re-testing it. We recommend keeping a backup monitoring strategy (for example, an in-room caregiver or a second monitor of a different type) for any situation where missing an alert would be unsafe.

By using BabyFoon you acknowledge and accept these limitations.

3. Subscriptions and payment

BabyFoon is offered as a €4 / year auto-renewing subscription with a 1-day free trial, sold through the Apple App Store and Google Play.

• Payment is charged to your App Store or Play account at confirmation of purchase, after any applicable trial.
• Your subscription auto-renews unless you cancel at least 24 hours before the end of the current period. You manage your subscription, including cancellation, in the App Store or Play Store account settings.
• Refunds are handled by Apple and Google according to their own policies. We cannot issue refunds directly for purchases made through their stores.
• Prices may change. We will give reasonable notice in-app before any price increase, and you will be free to cancel before it takes effect.

4. Acceptable use

You agree to use BabyFoon only for personal, non-commercial purposes — that is, for monitoring children or other people in your household, with their consent (or, in the case of children, with the consent appropriate to your jurisdiction).

You agree not to:

• Use BabyFoon to record, monitor, or surveil any person without their knowledge and consent, except where you have lawful authority to do so (e.g. a parent monitoring their own minor child).
• Reverse engineer, decompile, or attempt to derive the source code of the app, except to the extent that such activity is expressly permitted by applicable law.
• Use BabyFoon to violate any law, including privacy and wiretapping laws applicable in your jurisdiction.
• Probe, attack, or disrupt our backend infrastructure, or attempt to bypass security features such as the encryption between paired devices.

We may, with reasonable notice where practical, suspend access to the cloud relay for accounts or devices we reasonably believe are abusing it. Because we do not operate user accounts, this is rare and operates at the level of pairing handshakes and relay traffic.

5. Privacy

How we handle your data is described in our Privacy Policy. The privacy policy is part of these terms.

In short: we never see decryptable audio, we don't sell data, we don't run third-party trackers in the app, and we don't run trackers on this website.

6. Intellectual property

The BabyFoon app, name, and logo are owned by CB Engineering BV. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for the duration of your subscription (or, where the app is provided free, for as long as we make it available).

You retain all rights to anything you create or store on your own device using the app (for example, your local sleep journal). We have no rights over your data.

7. Disclaimers

To the maximum extent permitted by applicable law:

• BabyFoon is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.
• We do not warrant that any alert will be delivered, that any alert will be timely, or that any alert will be heard.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence.

8. Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you for any and all claims arising out of or relating to BabyFoon, in any 12-month period, is limited to the amount you paid us for the app in that period (which, for most users, is €4). We are not liable for indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill.

This limitation does not apply to the categories of liability listed at the end of section 7 (fraud, gross negligence, etc.) where applicable law forbids such limitation.

If you are a consumer in the EU/EEA, your statutory rights under your local consumer protection law are not affected by these terms.

9. Termination

You can stop using BabyFoon at any time by uninstalling it. Cancelling the subscription is done through the App Store or Play Store as described in section 3.

We can stop offering the app or any feature of it, with reasonable notice where practical. If we stop offering the app entirely, we will not charge you for any period during which the app is unavailable, and we will refund the prorated remainder of any prepaid subscription where required by applicable law.

10. Changes to these terms

We may update these terms from time to time. If we do, we will update the date at the top, and for material changes we will surface a notice in-app the next time you open BabyFoon. Continued use of the app after a material change means you accept the new terms; if you do not accept them, stop using the app and cancel your subscription.

11. Governing law and disputes

These terms are governed by the laws of Belgium, without regard to conflict-of-laws principles. The courts of Antwerp, Belgium have exclusive jurisdiction over any dispute arising out of or relating to these terms or the app, except that:

• If you are a consumer in the EU/EEA, you may also bring proceedings in the courts of your country of residence, and you benefit from any mandatory provisions of consumer protection law in that country.
• The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
